Molester of a class IX girl studying near Siliguri given 3 years of rigorous imprisonment

SHYAMA MONDAL GETS THREE YEARS RIGOROUS IMPRISONMENT UNDER SECTION 12 OF THE PROTECTION OF CHILDREN OFFENCES ACT,2012- UNDER MIRIK POLICE STATION CASE 81/14.



The convict Shyama Mondal was a driver by profession and was doing business in carrying school children, his vehicle was a Mahindra Maximo Mini Van bearing registration No WB 73 C-1297. On August 23, 2014 at about 6:40 A.M. the victim girl (class XI student of a highly reputed school near Siliguri) was alone in the vehicles and no other students were present and as they reached in between No 17 Panighata Tea Garden and Panighata Region Forest the convict suddenly touched and tried to hold the hand of the minor girl child and also touched her body with ill motive, the girl was strong and fought back and raised hue and cry and escaped from the overt act, the convict threatened her if she narrated the incident to anyone. She was brave enough to report the matter to her Principal as she reached school and her father over the phone, thereafter a complaint was lodged and the accused arrested. Charge sheet was filed in the month of December 2014, in total 7 witnesses were examined. The Special Court under the POCSO Act cum Additional Sessions 2nd Court, Shri Anupam Mukherjee, Darjeeling, convicted Shyama Mondal, of Chenga Busty under Mirik Police Station for Rigorous Imprisonment for three years and a fine of Rs 2000/- in default an additional SI for six months under Section 12 of the Protection Of Children from Sexual Offenses Act, 2012.

Section 12 deals with Sexual Harassment, Section 11 defines it and the maximum punishment is three years.
