Shibnath Kumar Sharma given 10 years jail for raping a married woman in Darjeeling on Nov 2015

"I, have been observing this case since the very inception and had repeatedly asserted and consoled the victim and her family that the Judicial system in Darjeeling is the best, and as I had forecasted Justice has been delivered, Thank you the entire prosecution team such as Mr Pranay Rai, The District Public Prosecutor, Mr Shyam lal Pradhan Additional P.P, Mr Subroto Dutta, the Investigating Officer Sadar Police Station, Medical Officers etc who has multiplied our faith on Law, Yes!!! women are safe here and the Judiciary has made a great difference, please remember, we are becoming stronger and these speedy judgements has made all activists like us to gather more confidence and work more..." – Smt. Sangita Tamang a social activist, who interacted with the DT correspondent and was present along with the victim and her husband in the Additional Sessions Court I, where the Judgement was pronounced amidst a large audience. The husband of the victim (whose anonymity is to be retained) was full of tears and said they never ever expected that justice would be delivered so promptly and fairly.
IN SESSIONS 56/16 CORRESPONDING TO SADAR POLICDE STATION CASE 104/16 STATE VERSUS SHIBNATH KUMAR SHARMA...CONVICT.
The convict Shibnath Kumar Sharma along with victims family had migrated to Darjeeling few years ago from a village Rariaahi, P.O. Kumaiya, P.S. Chakla Sahi, in the District of Samastipur, Bihar, and were engaged with the jobs of skilled mason (Carpenter), they both were living at Mangalpuri, Victoria Road, 15 minutes walk west side of Chowk Bazar, Darjeeling, below Government High School area. The victim used to address the convict as dewar (Brother in law) and she used to be called Bhabi (Sister in law). It was in the year 2015, November  at about 6pm the convict came to the victims house who was preparing food, caught hold of her hand and wanted to have sexual intercourse but somehow the victim lady could escape from his clutches. After two days again he came to ask for apology, at about 12noon and seeing her alone, took advantage and raped her, this was in continuance in three repeated occasions. On May 17, 2016 at about 8pm the convict again came and attempted to rape the victim girl and thereafter she narrated the incident to her husband and a case was registered before the Sadar Police Station. The convict was arrested immediately and was an under trial prisoner. Charge Sheet under Section 173 Cr.P.C. was filed on July 22, 2016. Today the Court of the Additional Sessions Judge, Court I, sentenced the convict Shibnath Kumar Sharma, to Ten Years rigorous imprisonment and a fine of Rs, 20,000/- in default to suffer imprisonment for a further term of two years.
